SECTION ONE – GENERAL INFORMATION

1.1 Terms and Conditions Binding
The Terms and Conditions and all other obligations and rules detailed in writing on the Site (collectively, the “Terms and Conditions”) are by and between Cafrino, LLC (each, “Cafrino,” “Cafrino.com,” “the Site,” “us,” or “we”) and everyone who uses the Site (each, “you,” “user,” or “player”). By using the Site, creating an account, and/or participating in any tournament or service offered on the Site, you accept and agree to be bound by all terms, conditions and notices contained or referenced on the Site, including the most current version of the Terms and Conditions. The Site may modify the Terms and Conditions at any time. Your continued use of the Site following such modifications signifies your acceptance of those modifications. You are responsible for reviewing the Terms and Conditions periodically for any such modifications.

The Terms and Conditions constitute the entire agreement between you and us pertaining to the subject matter hereof and supersedes all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. No waiver of any of the provisions of the Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.

1.2 Governing Law and Disputes
The Terms and Conditions will be governed and construed in accordance with the laws of the State of New York, irrespective of any principles of conflicts of law.

By registering for an account and/or participating in any tournament offered on the Site, you agree that any dispute that cannot be resolved between the parties shall be resolved individually, without resort to any form of class action. You further agree that any legal action arising from any dispute shall proceed only in the state or federal courts located in New York County in the State of New York, or as otherwise determined by us, and you hereby submit to personal jurisdiction and venue in such courts for the purposes of litigating any such action.

1.3 Entire Agreement
The Terms and Conditions constitute the entire agreement between you and the Site and cannot be modified by you. The Terms and Conditions cannot be modified on an individual basis by any person affiliated, or claiming affiliation, with the Site. Nothing in this subsection will prevent the Site from modifying the terms of the Terms and Conditions and posting such modifications on the Site.

1.4 Severability
If any provision of the Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of the Terms and Conditions, which will otherwise remain in full force and effect.

1.5 No Cheating

You acknowledge and agree that you shall not cheat, attempt to cheat, or otherwise interrupt or attempt to interrupt the operations of the Site or any particular Site service or contest. If Cafrino believes in its sole discretion that you have engaged, or attempted to engage, in any act to cheat, use automated technology or otherwise unfairly alter your likelihood of winning, or to otherwise commit fraud with regard to the Site, then, in such an event, you will forfeit all prizes or winnings to which you may otherwise be entitled. Cafrino reserves the right to revoke any prize that was previously awarded if in its sole discretion it believes that you cheated.

SECTION TWO – TOURNAMENT RULES

2.1 Chips Cafrino
Chips are for entertainment purposes only and are not redeemable or transferable for funds or prizes whatsoever and cannot be used for any purpose except as provided in this section. Chips are not redeemable for any amount of currency or monetary value from Cafrino at any time.

2.2 Registration
You must register prior to the start time. Each tournament will begin promptly at the scheduled time set forth on the Site or when the tournament reaches registration capacity. If a player is registered for a tournament and seated at the table but not connected to the website before a hand starts, that player will be dealt cards, a blind will be posted for that player automatically, and that player’s hands will be blinded out until the player arrives, at which point that player may have already been eliminated from the game (i.e., out of chips). Each player in the same tournament will receive the same number of starting chips. The number of starting chips may vary from tournament to tournament depending on the number of players in Cafrino’s sole discretion. The game for all of these tournaments is No Limit Texas Hold ‘Em Poker.

Your account is not transferable. Under no circumstances, shall you allow or permit any other person or third party, including without limitation any person under the legal age to participate in tournament sweepstakes, and in no event any person under the age of eighteen (18) years, to use or re-use your account or your Identifiers in such a way that may breach the standards or laws in any Jurisdiction where you are located and/or are a resident, or where such other person is located and/or is a resident. Under no circumstances, shall any player have more than one account on Cafrino. Cafrino accounts are limited to one account per household. Any players found to have more than one account playing, or have played, in the same location may have any winnings revoked and their account closed. Cafrino may require, at any time, proof of identity in the form of a government issued identification. Any person found to have violated this section will not be entitled to collect any prizes or winnings and may be reported to the relevant authorities. Any player that refuses to provide valid identification, and/or additional identification verification requested by Cafrino, may have any winnings revoked and will be responsible for returning any past winnings upon request from Cafrino. Cafrino reserves the right to refuse or cancel your registration and/or account for any reason whatsoever at any time with or without notice to you. Any player with any previously closed or banned account is ineligible to play or receive any prize offered on the Site.

2.3. Rules for No Limit Texas Hold ‘Em Poker
In Texas Hold’em, there are two face-down cards for each player and five face-up community cards. The player who makes the best five-card poker hand with any combination of their two face-down cards and the five community cards wins the round. In a Texas Hold’em game, a disc or other marker is used to indicate which person is the “dealer” for the round. Before the cards are dealt, the person to the left of the dealer posts a bet called the small blind, a forced bet that is of a predetermined amount. The person to the left of the small blind posts the big blind, another forced bet which is usually double the small blind. The first two cards are dealt to each player face down (these are called the hole cards), and the person to the left of the big blind starts the first round of betting. (Notice that the big blind and small blind do not get to look at their cards before betting, thus the term “blind”). In the first round of betting, each player has three options: call, raise or fold. To call, the player must place a bet that is equal to the last bet placed. (For the first player in the round, this would be equal to the minimum bet.) A player may choose to raise their call bet by an additional amount, which the other players will then have to call. If one’s hole cards are not favorable, the player may simply choose to fold and sit out the round.

After all the players have finished the first round of betting, the first three community cards are dealt face-up on the board. This is called the flop. The second and all subsequent betting rounds start with the first player to the dealer’s left, and players now has the option to check. By checking, the player indicates interest in the pot without placing a bet. Any player may choose to place a bet, which the other players must then call. Players can still raise, if a bet has been made, or fold, if their hand is not favorable. After the second betting round, the fourth community card is dealt face-up (this is called the turn card). After the third betting round, the fifth and final community card is dealt (this is called the river card). A final round of betting ensues, and afterwards each player turns their hole cards face up. The highest hand that can be made with any combination of a player’s hole cards and the five community cards wins the pot. If two or more players have the same hand, the next highest card in the player’s hand (the kicker) is used to break a tie. If there is no kicker card (the tied players have used both hole cards, or have the exact same hand), then the pot is split between them. The dealer button is then passed clockwise to the next player and another round of play begins.

 

2.3.1 General Rules Applicable to All Tournaments
All tournaments will begin at the time or at the capacity designated in the tournament details.
Players will be assigned a seat and players may not change their assigned seat.
There is a random selection for the button at the start of the tournament determined by Cafrino at its sole discretion.
The button moves in the conventional clockwise manner so that no player receives the button twice in a row. Occasionally, a player may become the button without having played in the blinds due to other players being eliminated. This may happen to any player during the course of a tournament and therefore creates no long-term advantage.
If a player registers for any tournament and is inactive (does not participate) for a total of ten (10) hands, the player may be removed from the tournament at Cafrino’s discretion and will be awarded the corresponding prize, if any, for the place in which they are removed; no buy in will be refunded.
If two (2) players should be eliminated simultaneously, the player with the largest number of chips at the beginning of the hand will be designated as having finished higher. It is impossible for two (2) people to be eliminated simultaneously when going heads up at the final table.
The tournament finishes when one (1) player has won all the tournament chips and is declared the winner. Except for a qualifying for private MTT where it will be over when the number of people who qualify is reached.
Any play deemed unethical by the Sponsor in its sole discretion (including, without limitation, team play, soft play or chip dumping) will result in the applicable player(s) being disqualified from the tournament.
As players are eliminated over the course of a tournament, tables will be consolidated to keep a full complement of players. Players may be forced to post the blinds when arriving at a new table. Table reassignments are an inherent part of tournaments and apply equally to all players.
Internet issues may cause server interruptions and Sponsor will endeavor to limit such interruptions during a tournament, but Sponsor does not assume responsibility for any such problems. If a player chooses to sit out or is unable to reconnect, the player will still have cards dealt to the player and will automatically post blinds and antes. Players that are unable to reconnect during the allotted time will have their hand automatically folded.

2.4 Prize Amounts
The prizes for all tournaments are stated on the site near the tournament registration. Cafrino in its sole discretion reserves the right to offer different prize amounts for any tournament. If the prize amount will be different it will be stated directly on the site near such tournament. Cafrino in its sole discretion reserves the right change prizing amount, payout structure, date and/or time, and frequency of any tournament.

2.4 Cafrino Chips, Levels, and Level Tickets
Cafrino Chips and Levels are for entertainment purposes only, have no monetary value, are not redeemable or transferable for funds or prizes whatsoever and cannot be used for any purpose except as provided in this section. Chips are not redeemable for any amount of currency or monetary value from Cafrino at any time. Cafrino reserves the right to change level awards at any time, and such awards will be displayed directly on the site near each level game.

SECTION THREE – CONDITIONS AND OBLIGATIONS

3.1 Eligibility
To be eligible to register and open an account and/or participate in any tournament offered on the Site, you must: (a) be a natural person at least 18 years of age or older, who is assigned to the e-mail address submitted on your account registration form; (b) be a legal resident of the United States or Puerto Rico with a U.S. or Puerto Rico address and currently residing at the address in an eligible location; (c) be physically located within the U.S. or Puerto Rico; and (d) at all times abide by the Terms and Conditions. By using or accessing the Site, you represent and warrant that you have the right, authority, and capacity to enter into this agreement to abide by all the Terms and Conditions.

3.2 Additional Persons Not Eligible
Notwithstanding Section 3.1, the following persons are ineligible to receive any prize offered on the Site: (a) employees, officers, and directors (and their immediate family members) of Cafrino, its parent companies, subsidiaries, and affiliates; and any other person with access to non-public information regarding the operation of any tournament offered on the Site; (b) any players with previously closed or canceled account(s); (c) any person found to be in violation of section 3.11 (Limitations on Participation) below; and (d) any person to be found in violation of any terms in this agreement.

3.3 Legality and Taxes
You are subject to all laws of the city, state, federal, province and/or country in which you reside and from which you access the Site and are solely responsible for obeying those laws. Access to the Site may not be legal for some or all residents of, or persons present in, certain jurisdictions. You agree the Site cannot be held liable if laws applicable to you restrict or prohibit your participation. The Site makes no representations or warranties, express or implied, as to the lawfulness of your accessing the Site or participating in any tournament offered on the Site nor shall any person affiliated, or claiming affiliation, with the Site have authority to make any such representations or warranties.

The Site reserves the right (but has no obligation to you) to monitor the location from which you access the Site and to block access from any jurisdiction in which participation or access is illegal or restricted. The Site may require any participant receiving any prize to provide the Site with proof that he or she is, or was at the time the subject tournament was played, eligible to participate according to the Terms and Conditions. This includes proof of identity and/or eligibility, which may include proof of social security number, proof of residency, and/or state/government issued identification. Without limiting any contrary provision of the Terms and Conditions, if the Site monitors your access or participation on the Site, the Site shall not be liable for the effectiveness of such monitoring. By accessing, using, or downloading in any way any materials on the Site, or merely browsing the Site, or creating an account and/or participating in any tournament or service offered by or through the Site, you represent and warrant that you are doing so in compliance with the Terms and Conditions and agree to indemnify and hold harmless the Site for any liability, claims, and damages (including attorneys’ fees) arising out of or related to your violation of the Terms and Conditions.

It is the policy of the Site, and in compliance with United States Internal Revenue Service regulations, the Site may send an IRS Form 1099 or other appropriate form to any person who wins in excess of $599.99 (USD) on the Site. We may require tax forms and identification at any time, including winnings under $599.99 (USD). Depending on the jurisdiction in which you reside, the Site may also send you additional tax forms. We do not withhold any taxes and you remain solely responsible for paying all federal and other taxes in accordance with the laws that apply in your local, state, province, and/or country of residence.

3.4 Acknowledgment of Proprietary Rights
By registering for an account and/or participating in any tournament offered on the Site, you acknowledge that all information contained on the Site may be protected, in all forms and media, by one or more valid copyrights, patents, trademarks, trade secrets, or other proprietary rights, and that all such rights are owned by the Site. You may not modify, publish, participate in the transfer or sale of, create derivative works from, or in any way exploit this information, except that you may download one copy for your personal, non-commercial in-home use only, provided you keep intact all copyright and other proprietary notices. The Site neither warrants nor represents that your use of materials displayed on the Site will not infringe rights of third parties. While the Site uses reasonable efforts to include accurate and up-to-date information, the Site makes no warranties or representations as to its accuracy. The Site assumes no liability or responsibility for any errors or omissions in the content of the Site.

Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like, are and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by the Site or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast, Site promotion, marketing and posting. Furthermore, the Site is free to use any ideas, concepts, know-how or techniques contained in any communication you send to Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information, without any additional compensation or other liability or obligation whatsoever to you.

The trademarks, logos, and service marks (collectively the “Trademarks”) displayed on the Site, including the names of all games and puzzles, are registered and unregistered Trademarks of the Site and/or others. Nothing contained on the Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of the Site or such third party that owns the Trademark displayed on the Site. Your misuse of any Trademark displayed on the Site, or any other content on the Site, except as provided in the Terms and Conditions, is strictly prohibited. You are also advised that the Site will aggressively enforce its rights (including intellectual property rights) to the fullest extent of the law, including but not limited to, the active pursuit of criminal prosecution and/or civil litigation where appropriate.

3.5 Promotional Activities
By registering for an account, you agree that the Site may display your username and tournament records. By accepting any prize from the Site, you agree to allow the Site to print, publish, broadcast and use, worldwide, in any media and at any time, your name, picture, voice, likeness, and/or biographical information for promotional, marketing or related purposes without additional compensation.

3.6 Submissions
If you send comments, questions or suggestions, including, but not limited to, notes, text, drawings, or computer programs, to the Site, such submissions shall become, and shall remain, the sole property of the Site. No submission shall be subject to any obligation of confidence on the part of the Site. The Site shall exclusively own all rights to, and shall be entitled to unrestricted use of, all such submissions without any compensation to you whatsoever.

3.7 Information Required
At registration, you are required to submit the following information: an alias that will be your username, a password and your e-mail address, as well as your location, timezone The Site reserves the right, in its sole discretion, to change and/or suspend/terminate aliases as the Site deems fit. If your total winnings on the Site in any given year reach $600, the Site will request that you submit your social security number in order to send you an IRS Form 1099, or other appropriate form, as required by Internal Revenue Service regulations. Failure to provide your social security number at that time will result in the Site’s inability to credit your account for any winnings in excess of $599.99.

3.8 Accuracy of Information
You represent and warrant that all information you supply to the Site is complete, accurate and current. Knowingly submitting incomplete or inaccurate information, or failing to update and maintain current, complete and accurate information, may result, without limitation, in immediate termination of your account and forfeiture of any prizes or winnings.

3.9 Privacy Policy
Information collected on the Site will be held pursuant to the Site’s privacy policy which can be viewed here.

3.10 Chat Policy and Code of Conduct
Rules of Conduct:
The Site reserves the right to temporarily or permanently ban users who violate these rules of conduct or who in any way abuse the community purpose of the chat areas, as determined by the Site in its sole and absolute discretion.
The Site reserves the right to remove any post for any reason or no reason.
Profanity, obscenities, or the use of **asterisks** or other “masking” characters to disguise such words, is not permitted.
Obscene, lewd, slanderous, pornographic, abusive, violent, insulting, indecent, threatening and harassing language of any kind, as determined by the Site in its sole and absolute discretion, will not be tolerated.
Site usernames will be displayed as ‘Your Name’; impersonating other players is not allowed.
Opinions or comments on the subject at hand are welcomed, but attacking (flaming) individuals, companies or products is not allowed.
Please limit posting on message boards or the Site to the subject of the Site’s games, message board or site content.
Advertising or promotion of any kind, including without limitation other companies or URLs, is NOT allowed.
Do not share personal information (your name, phone number, home address, and password) with others on the site.
Information disclosed in the Site chat rooms becomes property of the Site and is revealed to the public. The Site is not responsible for any information you choose to disclose to others.
Chat will become disabled when a player is all-in.
Players and observers are required to use the chat function in a friendly and considerate way. At no time are players and observers allowed to discuss or comment on live hands. At no time are players and observers allowed to chat in any language other than English. Cafrino reserves the right, in its sole discretion, to remove the chat privilege and/or permanently ban the account for any user in violation of this requirement. Any verbal or written abuse to Cafrino players or Cafrino staff will result in closure of the account and forfeit of all winnings.

3.11 Limitations on Participation
You may establish only one account per person with only one account per computer or IP or physical address, to participate in the activities offered on the Site. The Site reserves the right to monitor all activities on the Site, including without limitation, any effort to establish multiple accounts; in the event the Site discovers that you have opened more than one account per person or more than one account per computer, address, IP, or physical location, all additional accounts may be closed without notice and may result in the termination of any and all of your accounts and Cafrino may void any associated winnings. The Site also reserves the right to deny access to anyone, including, but not limited to, those players who use proxy servers and/or IP addresses residing in certain geographical areas.

3.12 Fraud and Abuse
The Site strictly prohibits user fraud and abuse relating to the access and use of the Site. In accessing the Site or participating in any activities, products or services offered by or through the Site, you represent and warrant that: (a) all information you supply is complete and accurate and not in violation of any applicable laws, regulations and the Terms and Conditions and (b) you will not circumvent or attempt to circumvent any provision of the Terms and Conditions or engage in any activity that interrupts or attempts to interrupt the operation of the Site. Anyone who engages in, participates in, or displays behavior that may be interpreted, in the Site’s sole and absolute discretion, as the use of unfair methods on the Site, including but not limited to, the opening and/or use of multiple accounts, the use of unauthorized or altered software or hardware to assist play (including the use of bots, bot nets, collusion with bots and/or use of poker software or programs), intentionally poor play in certain games in order to achieve a broader competitive advantage, collusion with other players, harassment of other participants, posting of objectionable material, any breach of the Terms and Conditions, any breach of the security of your account or the Site, found to have more than one account playing in the same location, or any other act (whether through the use of automated technology or otherwise) that unfairly alters your chance of winning or constitutes the commission of fraud (collectively, “Abuse”), you shall be subject to immediate sanction (as determined by the Site in its sole and absolute discretion), including without limitation: (1) immediate termination of your account and blocking of Site access; (2) any prizes, winnings and any other representative of value (if any) that you may otherwise have been entitled to receive shall be void and/or forfeited; and (3) any prizes, winnings and representative of value already received by you shall be subject to disgorgement and/or recoupment by the Site. Without in any way limiting any provision of the Terms and Conditions, the Site expressly reserves the right to institute or seek any injunctive relief, civil and/or criminal proceedings against you and/or any of your co-conspirators arising out of or related to your commission of Abuse, including the right to recover fees and expenses (including attorneys’ fees) and the right report you and such abuse to any and all relevant regulatory authorities or governmental agencies.

3.13 Withdrawal Requests
Users may request a withdrawal of funds from their available account balance at any time. Approved withdrawals will be sent via PayPal to the email address associated with the user’s Cafrino account. Processing of requested funds via PayPal account may take up to ninety (90) days; provided, however, the Site reserves the right to freeze a user’s account and/or delay a request for withdrawal of funds pending completion of any investigation of reported or suspected abuse by a user requesting withdrawal of funds.

3.14 Beta Testing Agreement
Cafrino is currently in beta testing. By participating at Cafrino during beta, you agree and understand that the beta testing process is used to identify any issues with the software. Due to the nature of software in beta testing, all users agree and understand that some failures may result in loss of tournament and/or place in tournament. All users agree to report potential game issues to our support team at [email protected]. Users may also be required to participate in assisting to identify the cause of any issues, which may include sending information regarding the type of computer, operating system, and any browser information. Users that continue to experience the same issue may also be required to download software to help identify the cause of the issue(s). Failure to assist in this process may result in closure of the account and forfeit of all winnings. Users that continue to experience issues after all attempts to fix the issues have been exhausted may be asked to discontinue involvement until the beta period is complete.

3.15 Ad Blockers and/or Ad Blocking Technology

By participating at Cafrino, you agree and understand that ad blockers or any ad blocking technology is strictly prohibited. Any account that has been found to be using such technology  (as determined by the Site in its sole discretion), all winnings will be forfeited and the account may be closed.

SECTION FOUR – DISCLOSURES

4.1 Odds and Prizes
The results of all tournaments offered on the Site depend on the number of the players participating in such tournaments and the skill of the players in such tournaments; precise odds of winning are therefore unavailable.

4.2 Winners Lists
A preliminary list of winners will be posted on the Site immediately following each tournament, except in the case of tournaments with substantial (as determined by the Site in its sole discretion) prizes, where lists may be delayed for up to five (5) business days while verification of the results takes place in order to help prevent potential Abuse. Final winners will be posted following completion of the applicable tournament.

4.3 Determination of Winners
The results and winners of each tournament offered on the Site will be determined by the Cafrino in its sole discretion and such determinations are final and binding. By registering and/or participating in any tournament, you agree to be bound by these determinations.

SECTION FIVE – LIMITATION OF LIABILITY

5.1 General Disclaimer
BY REGISTERING FOR AN ACCOUNT AND/OR PARTICIPATING IN ANY TOURNAMENT OFFERED ON THE SITE, YOU AGREE THAT: (1) THE SITE IS NOT RESPONSIBLE OR LIABLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM USE, ACCESS, OR ATTEMPTED USE OR ACCESS OF THE SITE; (2)THE SITE IS NOT LIABLE FOR ANY DAMAGE, LOSS, OR INJURY CAUSED BY DOWNLOADING ANY INFORMATION FROM THE SITE; (3) THE SITE IS NOT LIABLE OR RESPONSIBLE FOR LOSSES DUE TO VIOLATIONS OF THE TERMS AND CONDITIONS BY OTHER PLAYERS; AND (4) THE SITE HAS NO RESPONSIBILITY TO ENFORCE THE TERMS AND CONDITIONS FOR THE BENEFIT OF OTHER PLAYERS. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU AGREE THAT THE SITE IS NOT LIABLE FOR ANY DAMAGE TO YOUR PERSONAL COMPUTER, ANY DAMAGE, LOSS, OR CORRUPTION OF DATA, OR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING FROM USE OF THE SITE.

The Site also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video or audio from the Site.

In case of a malfunction or disruption of service for which the Site is responsible that prevents you from completing a tournament in which you have begun to participate, the Site will, upon receipt of a refund request and verification of the status of the alleged malfunction or disruption of services, refund the entry fee charged for that unfinished tournament entry only. The Site reserves the right to determine, in its sole discretion, whether it is responsible for any such malfunction or disruption. The Site also reserves the right to limit your tournament play or terminate your account should the Site determine, in its sole discretion, that you have intentionally caused such a malfunction or disruption. The Site is not liable for any potential winnings from any unfinished tournament.

5.2 No Warranty
ALL GOODS AND SERVICES PROVIDED ON THE SITE ARE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. You acknowledge that full freedom from errors and incompleteness is impossible to achieve with respect to computer software. If you become aware that the software contains any error, or is incomplete, you shall immediately notify Cafrino by e-mail at [email protected]. You agree to refrain from taking any advantage whatsoever of that error or incompleteness and Cafrino reserves the right to recover any such advantage that you do gain from such error or incompleteness, as well as all associated costs, damages and expenses in making such recovery. Cafrino will not be liable for any alleged winnings that are, in Cafrino’s sole discretion, the result of a system error or malfunction.

5.3 Hacking, Tampering, or Unauthorized Access
By registering for an account and/or participating in any tournament offered on the Site, you agree that the Site is not responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Site or your account.

Any attempt to gain unauthorized access to the Site’s systems or any account, interfere with procedures or performance of the Site, or deliberately damage or undermine the Site is subject to civil and/or criminal prosecution and will result in immediate termination of your account and forfeiture of any prizes to which you are otherwise entitled.

Any attempt to participate in any tournament offered on the Site by means of automatic, macro, programmed, or similar methods, or to otherwise commit fraud with regard to the Site, will result in active pursuit of civil litigation and/or criminal prosecution, termination of your account, and forfeiture of all prizes to which you might otherwise be entitled.

5.4 Accounts for Individual Use Only
You, as the holder of your account, are solely responsible for all obligations and, assuming compliance with the Terms and Conditions, are entitled to all benefits accruing thereto. You may not allow any other person to access your account, access the Site, accept any winnings, or participate in any tournament using your account information. Your account is not transferable to any other person. By registering and/or participating in any tournament offered on the Site, you agree to indemnify, defend, and hold the Site harmless from or for any claims, liability, damages, and/or costs (including attorneys’ fees) arising from any use of your account by any person.

5.5 Account Termination
The Site reserves the right to terminate your account, limit or prohibit your participation in any game, tournament or for any reason. By registering for an account and/or participating in any tournament offered on the Site, you consent to allow the Site to access your account information to investigate complaints or other allegations of Abuse.

If applicable, all charged monies (deposits), less entry fees and withdrawals, will be returned to the player. All winnings (if any) may be voided at the sole discretion of the Site.

SECTION SIX – ONLINE PURCHASES

6.1 Ad-Free Experience

Online purchases are for the Ad-Free experience and virtual goods only. The Ad-Free Experience allows you to disable advertising during game play. Cafrino reserves the right to display house messaging in place of advertising.

6.2 Virtual Currencies and Goods

The Service may include an opportunity to earn or purchase virtual, in-game currency, including but not limited to virtual coins, points, tokens, credits, bonuses or chips all for use in the Service (“Coins”) or virtual in-game items or collections (together with the Coins, “Virtual Items”). If you wish to purchase Virtual Items you will be required to pay a fee using “real world” money to obtain the Virtual Items. Virtual Items can never be redeemed or cashed out for “real world” money, goods, or any other item of monetary value from Cafrino or any other party unless otherwise expressly authorized by Cafrino in the framework of its Services. You understand that you have no right or title in the Virtual Items appearing or originating in any Cafrino game, whether “earned” in a game or “purchased” from Cafrino, or any other attributes associated with an Account or stored on the Service. Your purchase of Virtual Items is final and is not refundable, transferable or exchangeable, except in Cafrino’s sole discretion. You may not transfer, purchase, sell, or exchange Virtual Items outside the Service, or the purported sale, gift or trade in the “real world” of anything that appears or originates in the Service, unless otherwise expressly authorized by Cafrino in writing. We won’t recognize those transfers as legitimate. Accordingly, you may not sublicense, trade, sell or attempt to sell in-game Virtual Items for “real” money, or exchange Virtual Items for value of any kind outside of a game, without Cafrino’s written permission. Doing so is a violation of these Terms and may result in termination of your Account and/or legal action taken against you, any such transfer or attempted transfer is prohibited and void. Other than a limited, personal, revocable, non-transferable, non-sublicense able license to use the Virtual Items with the Services, you have no right or title in or to any such Virtual Items appearing or originating with the Services, or any other attributes associated with use of the Services or stored within the Services. Cafrino retains the right to manage, regulate, control, modify and/or eliminate Virtual Items at its sole discretion, and Cafrino shall have no liability to you or anyone for the exercise of such rights. Prices and availability of Virtual Items are subject to change without notice. In addition to the foregoing, Cafrino may selectively remove or revoke Virtual Items associated with your Account upon its sole discretion.

6.3 Purchases of Virtual Currencies, Virtual Goods, and Ad-Free Experience

By purchasing any vitrual products, you authorize the Company to charge applicable fees to your designated credit card. By purchasing any vitrual product memberships, you authorize the Company to charge applicable recurring fees to your designated credit card or approved payment method. Monthly subscriptions are billed on a 30-day cycle, which begins upon successful registration (or at the end of a limited trial period, if applicable to a promotion that you joined through) and ends 30 days thereafter. If you have signed up for an annual or quarterly subscription plan, you will be billed immediately. Your membership will be extended through the end of the billing cycle of your then pre-existing subscription plus the applicable number of days for the annual or quarterly plan chosen. All subscription membership plans renew automatically at the end of the applicable billing cycle unless you cancel your subscription plan before the end of the cycle. If, upon the scheduled subscription renewal date, the annual or quarterly plan billing attempt fails, you will be downgraded to a monthly membership and billed accordingly. If your use of our Services is subject to use or sales tax, then the Company may also charge you for any such taxes, besides the subscription fee or other fees published at the Company. The Company reserves the right to change the fees, charges or billing methods in effect, or add new fees and charges, at any time. The Company will announce these changes in advance. You are responsible for reviewing the Company Site to obtain timely notice of such changes. Continued use by you of the Service after notice of the changes constitutes acceptance of such changes. To cancel your subscription membership, visit the Site, log in to your account, go to your account profile by clicking your screen name and then click ‘edit’ under membership status. Your subscription membership fees are payable in advance and are not refundable in whole or in part for any reason. Credit Card Authorizations for Free Trial Memberships are required. You must provide credit card information to register for all trial offers to the Subscription Service. By signing up for a free trial, you agree that the Company may obtain a pre-authorization of up to $49.99. Some financial institutions may perceive these requested amounts as actual pending charges. While not actual charges, the Company is not responsible for any results, such as an overdraft fee, that may occur to your account because of pending charges. If you accept a free trial of a paid Membership, we will bill your account when the free trial expires, unless you cancel your free trial before that time. If you choose to cancel your free trial before the free trial expires, your account will be reverted to a free basic account immediately. You are responsible for any Internet service provider, telephone, wireless and other connection fees that you may incur when using the Site, even when we offer a free trial. Trial memberships may not be transferred at any time to any other user. Trial memberships are limited to one per person and one per credit card number. Paid Subscriptions may be purchased on a monthly (or quarterly or annual when special promotions are running) recurring basis.

6.4 Refund Policy

You agree that all purchases are final. No refunds will be given, except in our sole and absolute discretion. All Virtual Currencies and Goods will be forfeited if your account is deactivated for any reason at the company’s discretion. If you cancel a recurring membership, your membership will continue until the end of the billing cycle. At that time, your account will revert to a free basic account.
